Privacy notice

Data controller

Marcos Yered García Ramos, doing business as EXCAVATORS.MX, with address at Camino del Caño 134, Col. Tlacotengo, Fortín, Ver., ZIP 94470, Mexico, is responsible for the processing of your personal data under the Federal Law on Protection of Personal Data Held by Private Parties.

Personal data we collect

  • Contact: name, phone, email and the messages you send us (WhatsApp, email, forms, social media).
  • Identification and shipping: full name and delivery address (ZIP code, state, municipality, neighborhood, street and number).
  • Invoicing: legal name, RFC (tax ID), tax regime, tax address and CFDI use, only if you request an invoice.

We do not request sensitive personal data. Card numbers are entered directly on PayPal's or Mercado Pago's platform; Excavators.mx does not receive or store them.

Cookies and similar technologies

This site does not use advertising or analytics cookies. Your cart is saved only in your own browser's local storage so it is not lost between pages; you can delete it by emptying the cart or clearing your browser data. When you pay, PayPal or Mercado Pago may use their own cookies under their privacy policies. If we ever add analytics or advertising tools, we will ask for your consent first and update this notice.

Security and retention

We apply administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing. We keep your data only as long as necessary for the purposes described and to comply with tax and commercial obligations.

Purposes

Primary purposes (necessary for the relationship with you):

  • Answering your requests for information, quotes and service.
  • Processing your purchase, rental or service: billing, collection and invoicing.
  • Shipping and delivering products, and following up on returns and warranties.
  • Managing the commercial relationship and complying with legal obligations.

Secondary purposes (not necessary; you may refuse them):

  • Sending promotions, new products and offers.
  • Satisfaction surveys and service quality evaluation.

If you do not want your data used for secondary purposes, write to ventas@excavators.mx. Refusing will not affect the services you request from us.

Data transfers and sharing

Your data may be shared with the following processors, solely to fulfill the purposes above: courier and freight companies (to deliver your order), financial institutions and payment processors such as PayPal and Mercado Pago (to collect payment), the authorized tax certification provider (PAC, to issue your invoice), technology providers that host our systems, and marketplaces such as MercadoLibre or Amazon when you buy through them. We do not sell your personal data.

Artificial intelligence

To answer messages and organize information we use AI services from Anthropic, PBC and Google LLC as data processors, under their terms that prohibit using that information to train their models. We never send them tax IDs, bank accounts or card numbers.

Google and YouTube APIs

When we use Google or YouTube services through their APIs, the information obtained is used only for the purposes described here and complies with the Google API Services User Data Policy, including the Limited Use requirements.

ARCO rights and revocation of consent

You have the right to Access, Rectify, Cancel or Object to the processing of your personal data (ARCO rights), and to revoke your consent. Send your request to the Administration department at ventas@excavators.mx or call 273 109 6770, including your name, a means to reply, a document proving your identity (or that of your representative), a clear description of the data and the right you wish to exercise. We will reply within 20 business days and, if applicable, carry it out within the following 15 business days.

If you believe your right to data protection has been violated, you may go to the competent authority (Secretaría Anticorrupción y Buen Gobierno).

Any change to this privacy notice will be published on this page, with its update date.
